John Wlad and Sons Construction Limited pleaded guilty to operating an aggregate pit on Crown land without a permit.
The court heard that John Wlad and Sons Construction Limited own a private land pit in McCart Township, near Iroquois Falls. On May 1, 2014, a Ministry of Natural Resources and Forestry conservation officer observed that the private land pit was under operation and excavation work was occurring very close to the Crown land property line.
A subsequent inspection conducted on June 19, 2014 determined that the company’s ongoing pit operations had expanded onto the neighbouring Crown lot.
A surveyor was hired to mark the property line and calculations determined at least 44,664 cubic metres of sand type aggregate had been excavated and removed from Crown land without a permit.
Justice of the Peace Sylvie-Emanuelle Bourbonnais heard the case in the Ontario Court of Justice, Timmins, on February 26, 2015.
