Female Charged for Refusing to Provide Breath Sample

MARATHON, ON – On February 7, 2018 at approximately 3:35 a.m. officers of the Ontario Provincial Police (OPP) Marathon detachment were on general patrol in the Town of Marathon.

Officers observed a vehicle traveling at a high rate of speed and a traffic stop was conducted on the vehicle. When the officers approached the vehicle they found it to be driven by a lone female occupant. An officer could detect the odour of alcohol as well as observed other signs of possible impairment.

The driver was requested by police several times to provide a sample of her breath to determine if she was impaired by alcohol. The driver refused to provide a sample and as a result, the 30 year old female, [edited] of Marathon, ON was arrested and charged with, Fail or Refuse to Provide Breath Sample, S.254(5) of the Criminal Code of Canada.

She was issued a mandatory 90 day drivers licence suspension as well as her vehicle being impounded for 7 days. She is to appear at the Ontario Court of Justice in Marathon on March 28, 2018 to answer to the charge.

Motorists who drive impaired by alcohol or drugs are subject to drivers licence suspensions, fines, vehicle impoundments, criminal records and increased insurance costs. Please drive responsibly and don’t drink and drive.
