McGuinty Government Nominates Labour Relations Expert Diane Gee

Ontario has nominated Diane Gee for appointment as Chair of the Public Sector Compensation Restraint Board, subject to review by the Standing Committee on Government Agencies. 

Ms. Gee is currently the Interim Chair of the Ontario Labour Relations Board and Chair of the Pay Equity Hearings Tribunal. She has taught an Advanced Course in Labour Relations at the Masters of Law Program at the University of Toronto and Labour Relations Law at the University of Toronto Centre for Industrial Relations and Human Resources.  Ms Gee has also practised labour and employment law in the private sector.

The Public Sector Compensation Restraint Board is a newly created adjudicative tribunal that was established to make determinations regarding the Public Sector Compensation Restraint to Protect Public Services Act, 2010.

Employers, employees, office holders and the Minister may apply to the Public Sector Compensation Restraint Board for an order declaring whether the act applies to an employer, an employee, a group of employees or office holder.   Individuals may make an application only in respect of a matter that could affect him or her personally. The board does not have the authority to make an order relating to a compensation plan.

QUICK FACTS

  • The Public Sector Compensation Restraint to Protect Public Services Act, 2010, establishes restraint measures with respect to the compensation plans of certain public sector employers and employers who receive significant funding from the Government of Ontario, their employees and office holders.
  • The act applies to all public sector employers and other employers who meet the funding threshold unless employees are represented by an organization for the purposes of collectively bargaining the terms and conditions of employment specifically relating to compensation.
  • Municipalities and local boards of municipalities, with the exception of health boards, are not subject to the act.
  • The board will be a short-term body, and will be dissolved when its work is completed. The restraint period ends March 31, 2012.
