Pays Plat FN Requests Confidentiality of Marathon PGM Cu Mine Project Review Panel

MARATHON PGM-Cu MINE Project JOINT REVIEW PANELPlease see the letter below from the Marathon Joint Review Panel regarding a request for confidentiality received from the Pays Plat First Nation.  As per the Procedures for Requesting Confidentiality, the Panel is making this request available for a comment period.  Any comments should be submitted by November 9, 2012.

To all Interested Participants:

RE: Request for Confidentiality from Pays Plat First Nation

On October 18, 2012, the Marathon Joint Review Panel (the Panel) received a letter from the Pays Plat First Nation dated October 15, 2012 requesting that all information it provides with respect to its Traditional Ecological Knowledge and its Traditional Land Use studies be treated as confidential by the Panel. Pays Plat First Nation proposes that this information be disclosed to the proponent, Stillwater Canada Inc., and to the Panel (and named staff supporting the Panel), but no other participants. In addition, the Pays Plat First Nation has requested that any oral information it provides at the community hearing sessions relating to Traditional Land Use and Traditional Ecological Knowledge also be provided in confidence during an in camera session.

In considering this request, the Panel will follow the process outlined in the final Procedures for Requesting Confidentiality, as follows:

Comments on Request for Confidentiality

The Panel is making the request by Pays Plat First Nation available for a public comment period. Interested participants may provide written comments on the request for confidentiality by November 9, 2012.

Response by Pays Plat First Nation

Following the comment period, Pays Plat First Nation may provide a written response to any of the comments received. The response from Pays Plat First Nation should be submitted by November 23, 2012.

Panel Decision on Request

After reviewing the comments received and any response from Pays Plat First Nation, the Panel will determine whether the disclosure of this information could potentially result in harm to either the environment or to the community of the Pays Plat First Nation.
